It is now a fundamental legal obligation, with a direct impact on labour compliance, business sustainability and the organisation&#8217;s reputation. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal framework is clear: continuing education is a right of the employee and an obligation of the employer, with rules, deadlines, mandatory reporting, and significant financial consequences in case of non-compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this article, we explain what the law requires, how to comply, and the risks of not investing strategically in training.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What does the law say about compulsory vocational training?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Labour Code stipulates that all companies must guarantee <strong>40 hours of continuous training per employee per year<\/strong>. This obligation applies to: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Open-term contracts;<\/li>\n\n\n\n<li>Fixed-term contracts with a duration of three months or more (on a pro rata basis).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, training must cover <strong>at least 10% of the company&#8217;s employees<\/strong> each year, ensuring a collective rather than ad hoc approach to qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Training may focus on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the role performed;<\/li>\n\n\n\n<li>In related areas;<\/li>\n\n\n\n<li>Or in strategic and cross-cutting areas, such as digital technologies, occupational health and safety, or foreign languages.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Training hours management: deadlines and critical rules<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The law allows for some flexibility, but with clearly defined limits:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Training may be <strong>brought forward or deferred for up to two years<\/strong>;<\/li>\n\n\n\n<li>If not provided within this period, the hours are converted into <strong>training credit in favour of the employee<\/strong>;<\/li>\n\n\n\n<li>This credit may be used at the employee&#8217;s initiative, subject to prior notification to the employer.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of termination of the contract, the outstanding training hours <strong>must be paid for<\/strong>. Currently, these credits are<strong> non-waivable<\/strong>, even in termination agreements. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>The role of the Single Report in oversight<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Compliance with professional training is monitored through the <strong>Single Report<\/strong>, a document that must be submitted annually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Annex C, companies must declare:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In Annex C, companies must declare: a) All training activities carried out;<\/li>\n\n\n\n<li>The training area (CNAEF);<\/li>\n\n\n\n<li>The duration;<\/li>\n\n\n\n<li>Whether the training was provided by the employer or the employee.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Omission or incorrect completion may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prevent access to public incentives;<\/li>\n\n\n\n<li>Raise alerts during ACT inspections;<\/li>\n\n\n\n<li>Increase fines in the event of inspections.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Fines and risks of non-compliance<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to undergo mandatory training constitutes an administrative offence. Fines vary depending on: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The company&#8217;s turnover;<\/li>\n\n\n\n<li>The degree of fault (negligence or intent).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In larger companies, the costs can run into several thousand euros, in addition to the impact on reputation and loss of internal confidence.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Training as a strategic asset, not a cost<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">More mature companies view training as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A legal risk mitigation tool;<\/li>\n\n\n\n<li>A pillar of talent retention;<\/li>\n\n\n\n<li>A factor in productivity and innovation;<\/li>\n\n\n\n<li>A key element of social sustainability.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Complying with the law is the bare minimum.
